Renewing your trade mark and changing information
There are limited in which you can change the details of your trade mark and you must renew your trade mark every 10 years to keep it in force.
Please be aware that companies and individuals are sending misleading invoices to applicants and registered owners of trade marks. These communications may appear to be official but they are not linked to the Intellecual Property Office or any other Government organisation.
Renewing
Renewing your trade mark
You can renew your trade mark for ever. However, to keep your trade mark in force, you must renew it on the 10th anniversary of the filing date and every 10 years after that.
Restoration
If you do not renew your trade mark in the 6 months after the renewal date, you have a further 6 months to apply to restore your registration.
Changing
Transferring ownership (assigning)
You can transfer ownership of your trade mark to someone else. This includes any change of ownership as a result of company mergers.
Transferring ownership (assigning) Community and Madrid trade marks
You can only transfer ownership of your Madrid or Community trade mark through OHIM or WIPO. This includes any change of ownership as a result of company mergers.
Changing or appointing an attorney
You can appoint or changea trade mark attorney at any time should you wish to do so by filing form TM33.
Changing your name or address
If you change your name or address you should tell us so that we can update the trade marks register.
Correcting an error
You may be able correct an obvious error in your application or trade mark registration.
Part surrender of a trade mark
You can use the form
TM23
(219Kb) to surrender some of the rights in your mark such as some of the goods or services registered.
Once surrendered the rights cannot be reinstated.
